The Conditional Release Act (the “Act”) applies to all prisoners regardless of when they were convicted or sentenced, including prisoners who have no right of abode in the Cayman Islands or are liable to be deported. Prisoners eligible for parole may apply to the Conditional Release Board (the “Board”) for the Board to consider their release from prison.

Eligibility for parole

Prisoners serving life sentences are subject to different rules than other prisoners. In particular, before lifers can apply for conditional release, they must first serve the minimum period of incarceration as the court considers appropriate to satisfy requirements of retribution, deterrence and rehabilitation.

For example, in the case of murder, the Act states that the minimum incarceration period is thirty years unless there are extenuating circumstances, exceptional in nature, in which case the court may impose a lower period of incarceration or aggravating circumstances, exceptional in nature, in which case the court may impose a longer period of incarceration.
