Some people wonder whether MP Alden McLaughlin could ever be returned as Premier of the Cayman Islands. The answer, in short, is “yes” and here’s why.

Cayman Islands Constitution (the “Constitution”)

The general rule under the Constitution is that a person who has held office as Premier during two consecutive parliamentary terms cannot be reappointed in that office in the immediately following parliamentary term.

For example, MP McLaughlin served two consecutive parliamentary terms and a new parliamentary term commenced subsequent to the recent general election. As per the rules of the Constitution, MP McLaughlin could not serve as Premier in the current term.

However, if the tables turn, then it could be Alden’s turn.

How a change in the office of the Premier could occur

Following the rules, a parliamentary term shall be deemed to be a period commencing when the Parliament first meets after being constituted under the Constitution or after its dissolution at any time, and terminating when the Parliament is next dissolved.

Since the parliamentary term finishes when Parliament is next dissolved, it is important to examine the relevant dissolution events.

One event is where the Governor, acting after consultation with the current Premier issues a proclamation at any time to dissolve Parliament.
